Terms and Conditions of the STEM Olympiad Membership

The following are the terms and conditions of this Agreement between the User (Student, Parent, Teacher and Representative) and the STEM Olympiad.

  1. The STEM Olympiad presently offers users access to diverse online educational platforms and assessments (Service). This Agreement pertains to these Services and any future or improved Services, unless expressly indicated otherwise. Certain Services, such as exam participation, necessitates payment from the User.
  2. Users must register to access specific Services. During registration, the User commits to providing all necessary information accurately. The STEM Olympiad holds the authority to suspend or cease Services to any User if it deems, at its sole discretion, that the registration details are inaccurate or incomplete. If you are below the age of eighteen (18), you may register only with the participation and approval of a parent, legal guardian, or under the guidance of a school representative.
  3. The STEM Olympiad Privacy Policy is contained in a separate document and is hereby made an integral part of this Agreement.
  4. When registering, the User chooses an email and password. It's essential for the User to keep this email and password confidential. The User is accountable for any actions carried out using this email and password. The User also commits to promptly informing the STEM Olympiad if they suspect any unauthorized use of their email and password, and to log out after each session. In essence, the User is responsible for safeguarding their account information and promptly reporting any security concerns.
  5. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials (Content), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that the User, and not the STEM Olympiad, is entirely responsible for all Content that the User uploads, posts, emails, transmits, or otherwise makes available via the Services. While the STEM Olympiad makes reasonable efforts not to allow offensive, indecent, or objectionable material on this site, by using the Services, the User may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will the STEM Olympiad be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted, or otherwise made available via the Service.
  6. The User agrees as follows:
    a. not to harm minors or cause minors to be harmed in any way;
    b. not to forge headers of postings, emails, or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Services;
    c. not to pretend to be someone else or represent yourself as someone you are not, which includes, but is not limited to, claiming to be a STEM Olympiad employee, guide, or guest when you are not, or providing false information about your association with any individual or organization.
    d. not to upload, post, send via email, transmit, or share any Content that is against the law, detrimental, menacing, abusive, distressing, malicious, defamatory, indecent, offensive, invasive of someone's privacy, or displays hate or racial, ethnic, or other forms of objectionable behavior.
    e. not to upload, post, send via email, transmit, or share any information that you deem to be confidential, as such posting could potentially lead to the loss of intellectual property rights for you or any third party associated with that information.
    f. not to upload, post, send via email, transmit, or share any Content that violates the legitimate rights of any party, including but not limited to patents, trademarks, trade secrets, copyrights, or other proprietary rights.
    g. not to replicate, duplicate, copy, sell, resell, or utilize any part of the Services, use of the Services, or access to the Services for any commercial purposes.
  7. The STEM Olympiad reserves the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
  8. The STEM Olympiad reserves the right to terminate, without prior warning, the access of any User to any Service or Content, for violation of any of the above Terms, or for any other reason at the STEM Olympiad’s sole discretion.
  9. This Agreement serves as the complete agreement between the parties and overrides all prior agreements, commitments, proposals, statements, understandings, and discussions, whether documented in writing or conveyed orally, concerning the subject matter described herein.
  10. This Agreement will be governed by the laws of Germany, without taking into account any conflict of law principles.
  11. Despite any statute or law that may suggest otherwise, both parties agree that any claim or legal action arising from this Agreement or connected to the Services must be filed within one year after the occurrence of such claim or cause of action or it will be permanently barred.
  12. If either party fails to exercise or enforce any right or provision outlined in this Agreement, it will not be considered a waiver of that right or provision.
  13. If any one or more provisions of this Agreement are determined to be invalid, illegal, or unenforceable for any reason, the remaining provisions of this Agreement will remain in full force and unaffected. The invalid, illegal, or unenforceable provision will be substituted with a provision that is valid, legal, and enforceable, and that aligns as closely as possible with the original intent of the parties.
  14. Force Majeure - Either party will be exempted from fulfilling its obligations and will not be held accountable for any delay, in whole or in part, due to unforeseeable events beyond the reasonable control of the excused party or its subcontractors or suppliers. These events may include, but are not limited to, war, sabotage, insurrection, civil unrest, acts of public enemies, transportation failures or delays, actions of any government or its agencies or subdivisions that affect the terms of this agreement, accidents, fires, explosions, floods, severe weather conditions, a pandemic, or natural disasters.
